TERMS OF SERVICE

Welcome to Contacter. By creating an account, downloading our software, or purchasing credit packages on this website, you agree to comply with and be bound by these Terms of Service.

1. SCOPE AND ELIGIBILITY​

  • B2B Service: This website and the Contacter Software Suite are intended strictly for commercial, corporate, and professional use (B2B).
  • Account Security: You are entirely responsible for maintaining the confidentiality of your account credentials, installation files, and generated API keys. Any software consumption or activity under your credentials will be deemed authorized by you.

2. ABSENCE OF SERVICE LEVEL AGREEMENTS (SLA) AND TECHNICAL SUPPORT​

  • No Technical Support Obligations: You explicitly acknowledge that Contacter is managed by a core specialized engineering team. No mandatory technical support, dedicated helpdesk, or guaranteed response windows are provided under these terms, especially during the Beta Phase. Assistance is provided strictly on a "best effort" basis.
  • No Uptime Guarantees: Licensor does not guarantee that the license verification servers, download portals, or web services will be uninterrupted or error-free. System maintenance may occur at any time without prior notice.

3. CONSUMPTION, PAYMENTS, AND NO-REFUND POLICY​

  • Pre-Paid Minutes: Access to transcription and ingestion tools requires the upfront purchase of credit packages. All pricing structures and the 10-year validity of those minutes are governed by our master Software License Agreement.
  • No Refunds: All commercial purchases of pre-paid credit packages are final and 100% non-refundable, regardless of whether the credits are fully consumed or if you terminate your usage of the software early.
  • Absolute Data Privacy: We do not collect, view, or store your customer interaction contents. All processing happens inside your chosen infrastructure. For billing and verification purposes, our system only records the generated session UUID and the total number of minutes or messages consumed per interaction. No audio, text body, or personal identity metrics are ever leaked or transmitted to us.
  • Reverse Engineering Prohibited: You agree not to modify, decompile, reverse engineer, or attempt to extract the source code of any closed executable files provided within the Contacter ecosystem.
  • Audio Recording Compliance: You are solely responsible for ensuring that all voice recordings, chats, and emails processed by the software comply with local and international privacy laws (including GDPR). You warrant that you have obtained all necessary customer consents required to record and transcribe these interactions.

5. BETA PROGRAM SPECIAl PROVISIONS​

  • Accounts participating in the free Beta Phase accept the software "AS-IS". Contacter shall have no liability for any software bugs, data translation errors, temporary platform downtime, or data synchronization issues that occur during testing.

6. GOVERNING LAW​

  • These Terms of Service are governed by the laws of Portugal. Any legal disputes arising from the use of this website or portal shall be exclusively resolved in the Courts of Lisbon, Portugal.
